While we are deeply disappointed with the Second Circuit’s opinion in Hachette v. Internet Archive, the Internet Archive has decided not to pursue Supreme Court review. We will continue to honor the Association of American Publishers (AAP) agreement to remove books from lending at their member publishers’ requests.
This was always going to be the outcome. The NEL was never going to be legally acceptable and they are smart to stop wasting resources on this fight.
I support the NEL and open access to information, to be clear. But I can’t imagine anyone thought they could win this. In fact the NEL in many ways was a pretty big strategic mistake that may very well have painted a target on the IA’s back for years to come
