A federal court has issued a ruling that redefines the boundaries of free speech in the United States. Judge Trevor N. McFadden ruled that ‘desecrating’ the Israeli flag is not political expression but racial discrimination.

The decision means burning, tearing, or grabbing the Israeli flag can be prosecuted as hate conduct. By contrast, the US Supreme Court has long protected the burning of the American flag under the First Amendment.

Does this mean that we can co-opt the image of the Israeli flag to make pro-Palestine, anti-genocide, and anti-facist messages that when ripped away from public places will make a hate crime?

Can we make the Israeli flag like 1 pixel on a poster so it’s a hate crime when a fascist rips it?

that’s an interesting idea. one pixel is hyperbolic, but here is a 5x7 that i bet could be argued.

The two issues are that the article seems to be a leap from the truth as WHARRGARBL pointed out, and that anti-genocide posters are bound by the law but not protected and the fascists are protected by the law but not bound.
